Brianna Aguilera witnesses heard screams of ‘get off me’ moments before cheerleader plunged to her death after tailgate
Her heartbroken family is fighting back at the cops’ decisions 
WITNESSES heard a Texas college student scream out before she plunged to her death following a tailgate event, lawyers representing the victim’s mother have claimed.
The family of Brianna Aguilera, 19, is begging for a closer look after cops refused to investigate her sudden death as a homicide.

The Texas A&M University student’s body was found outside an apartment complex in Austin on November 29, and cops say she fell from a high floor.
Detectives say that all signs are pointing to suicide, as Aguilera allegedly had a suicide note on her phone that she had deleted just days before her death.
In a press conference on Thursday, Homicide Sergeant Nathan Sexton said the teen had made “suicidal comments” dating back to October and had engaged in “self-harming actions” the evening of her death.
However, the student’s outraged family claims that a neighbor down the street from the apartment heard fighting early Saturday morning.

The witness heard, “‘Get off of me!’ and screaming, and then a muffled cry between 12:30 and 1 am next to the apartment,” attorney Tony Buzbee said in a conference on Friday.
Buzbee, a high-powered victim who has represented people allegedly victimized by Sean Combs, went on to claim that someone in the building also heard a ruckus.
“Another witness could hear running back and forth and screaming,” he said.
The lawyer accused cops of failing to speak with either of the witnesses and said the suicide ruling was premature.
He also claimed that the text which detectives had deemed a suicide note was actually a college essay.
“She wrote an essay on the 25th that she deleted – and then she goes and kills herself four days later? It’s really ridiculous,” he said.
“It’s total baloney what they’re trying to tell you.”
Despite hearing outrage from the family, the Austin Police Department has stood by its investigation.
“Sometimes the truth doesn’t provide the answers we are hoping for, and that is the case,” said Austin Police Chief Lisa Davis.
Aguilera was captured on surveillance footage entering the property with a group of friends at 11 pm and heading to a unit on the 17th floor.

According to lead homicide detective Robert Marshall, Aguilera had been at a tailgating event earlier that day, but got so intoxicated she was asked to leave.
The teen told her friends she had lost her phone, and it was later found abandoned at the event venue.
Aguilera used a friend’s cell phone to call an out-of-town boyfriend between 12:43 am and 12:44 am – just two minutes before cops were called to the scene.
Her body was found soon after, but her friends didn’t report her missing until the following afternoon, when they couldn’t find her.

Nov. 29: At 12:47 am, the Austin Police Department respond to a report of an unresponsive individual at an apartment complex on Rio Grande Street.
Austin police declare the female individual, identified as Aguilera, dead at 12:57 am. Authorities said the incident is not being investigated as a homicide and there are no “indications of suspicious circumstances.
Dec. 1: Aguilera’s mother, Stephanie Rodriguez, claims her daughter was the victim of foul play, despite authorities investigating the incident as a suicide.
Tita Hernandez, Aguilera’s aunt, told The U.S. Sun on the night her niece died her “GPS was pinging by a creek.”
