Even though Diddy was recently arrested and indicted on a scathing list of federal charges, the Bad Boy Records founder did secure a legal win in a lawsuit that previously ordered him to pay millions of dollars to a Detroit man in prison.
Last week, Derrick Lee Cardello-Smith learned he would be awarded $100 million in his civil suit against the disgraced music mogul. In the lawsuit, he claimed that he was drugged and sexually assaulted by Diddy at a Detroit party in 1997. Allegedly, the two met while Cardello-Smith was working at a local restaurant in the area.
Initially, a Michigan circuit court judge handed down a default judgment against Diddy because he did not appear for a virtual hearing. Furthermore, Cardello-Smith was also granted a restraining order, which would have prevented Puff from selling off any of his assets to pay for the suit.
But in a surprising turn of events, Diddy’s fortune has turned (in this particular case, at least). According to the Detroit Metro Times, a Michigan circuit court judge has reversed the ruling, meaning that the Bad Boy Records founder no longer has to pay the $100 million.
Why? David Fink, Diddy’s attorney, convinced the judge that Cardello-Smith and his legal team failed to prove that he served the lawsuit effectively to Puff in alignment with Michigan law. The judge also threw out the restraining order, saying the mogul has a high chance of winning the case on statute of limitations grounds since the alleged incident took place 27 years ago.
The Times also reports that Fink added that Cardello-Smith has no credibility, because he has been convicted of multiple crimes, including sexual assault.
Cardello-Smith did not seem to care about any of that. “This isn’t over,” he told Fink.
The likely next step Diddy and his legal team will make is to file a motion to have the entire suit dismissed. The Root will continue to update this story.
